“The deposition of Rich'd Southern of Calvert County, gent., aged fifty years or thereabouts viz't:

- “The deponent upon oath examined saith that on the 21st day of August instant p vertue of a praecept to him directed p the honoble Ne'a Blakiston Esq'r the 18th day of the said month he this deponent went therewith to the house of Coll'o Henry Jowles & told him that the Giv'r & Counc'cl required his attendance on Wednesday 23d said Aug'st he replied he would obey their orders he would wait upon them so he swings himself about & said God damn him this was nothing but what he did expect a parcell of shitten dogs of you & bid him this deponent go about his business he would be sure to be there himself the deponent thereupon told him there was more in it then so for him to go by himself for he this deponent had rec'd a warrant which directed him what to do & so shewed him the warrant which he read & said he had spoken nothing but what he had been beaten out of the deponent told him that as he was a gentleman if he would like a gentleman submit himself quietly to his custody he the deponent would be civil to him otherwise must take him by force & thereupon flew out into a passion & said they had forced him to give bonds & now God damn 'em they would beat him to make him break his bonds & when he came down before the Gov'r & Council he would declare what he thought before them all & several other words to that effect but after some space of time & his heat being over he promised this deponent & said upon the word of a gent that he would upon their Honours to which the deponent gave credit & discharged the said Collier from his further attendance on him & on the day appointed this depondent went to his house where he met with the said Jowles' wife who told this depondent the Coll'o was very sick & she was afraid he would die the depondent said he must see him she then conveyed him to the chamber where the said Jowles lay who told this depondent he was sorry he was sick & could not go with this depondent according to his promise but desired him to tell the Gov'r & Council when he was well he would wait upon them & further saith not”. 9/28/1703: The King vs. Kenelme Cheseldyn, Jacob Moreland, Thomas Beade, Richard Southerne, John Nutthall, James Swann, Ralph Parker, Gerard Sly, Justices of the St. Mary's Co. Court. Before his death, Gerard Sly charged that the above mentioned justices unlawfully levied more tobacco than they were entitled to levy for the defraying of costs of the said justices. He charged that these illegalities occurred in 1698 and 1699. He said that they had raised 20,000 lbs. more tobacco than was necessary to be raised. However, the said Sly being dead and no one else presenting themselves to prosecute the case, it was quashed. Prov. Ct. Jdmte. TL 3, p. 218-19. George Buck & Company agt. Alex. d'Hinojossa of St. Mary's Co.

- Alexander attached to answer unto Buck a plea of Trespass upon the Case. He claims that in Annapolis on 19 March 1701, Alexander paid debt to Buck & Co. with three Bills of Exchange, all of one Tenor and date, drawn by a certain Richard Sothoron on Capt. Timothy Keyser Merchant in London and dated 10 October 1701, by all which said three Bills of Exchange the Same Richard Sothoron did require payment of interest. Inasmuch as Alexander endorsed the Bills by signing them, he thereby guaranteed satisfaction of the debt and the interest and costs associated therewith. When Buck & Co submitted the Bills to Timothy Keyser for payment he answered that if said Richard Sothoron the Younger or if the Requirant could give him security that the same is Richard Sothoron Jun. he would pay, otherwise not.
